Terms and Conditions
This is a courtesy translation. Only the German version is legally binding.
These terms govern how we advise you on choosing your Kenya safari and obtain offers from our local partners for you. In short: our advice is free of charge and without obligation for you, and you book your trip – if you wish – directly with the partner whose offer convinces you.
1. Provider and scope
The provider is [Name or company incl. legal form], Hanne Nüte 3, 12359 Berlin, Germany, email: info@safarimarkt.de (“SafariMarkt”, “we”). These terms apply to all services we provide via safarimarkt.de, in particular the Safari Finder, the contact form and our personal advice.
2. Our services
- Recommendation: In the Safari Finder, you receive an automatically calculated recommendation of suitable National Parks in Kenya based on your answers.
- Personal advice: On request, we will get in touch with you and discuss your ideas.
- Offers from partners: Using your travel information, but without your name and contact details, we make enquiries with our local partners and forward their offers to you.
- Contact with the partner: If you would like to pursue an offer, we will put you in touch with that partner after you have given your express consent.
There is no entitlement to a suitable offer being made that matches your wishes.
3. We are not a tour operator
SafariMarkt does not organise trips and does not sell any travel services of its own. A contract for safari, accommodation or transfer services is concluded exclusively between you and the respective local partner. That contract is governed by the partner’s terms; price, scope of services, payment, cancellation and performance of the trip are determined solely by them. Before you book, we will tell you who your contractual partner is. 4. No obligation
Your enquiry via the Safari Finder or the contact form is non-binding and does not commit you to anything. Our recommendations and the offers we forward are for guidance only; whether you book, and with whom, is entirely your decision. Offers from our partners are valid only to the extent and for the period stated by the partner.
5. Costs
Recommendations, advice, obtaining offers and putting you in touch with partners are free of charge for you. [State whether and how SafariMarkt is remunerated by partners, e.g. commission on booking – and align the statements on the homepage and in the FAQ (“earn nothing from bookings”) accordingly.]
6. Your information
So that we can advise you properly, we ask you to provide accurate information. We accept no liability for recommendations and offers based on incomplete or incorrect information.
7. Liability
We advise you carefully and to the best of our knowledge. However, we cannot guarantee wildlife sightings, weather, water levels or similar natural conditions. The respective partner, as your contractual partner, is liable for the performance of the trip and the partner’s services.
We are liable without limitation for intent and gross negligence, as well as for damage resulting from injury to life, body or health. In cases of slight negligence, we are liable only for the breach of essential obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely; in this case, liability is limited to the foreseeable damage typical for this type of contract. Mandatory statutory liability provisions remain unaffected.
8. Data protection
How we handle your data – in particular, which travel information we pass on to our partners without personal identifiers – is explained in our Privacy Policy.
9. Changes to these terms
We may amend these terms with effect for the future, for example if our services change. For an enquiry already in progress, the version published at the time of your enquiry applies.
10. Final provisions
The law of the Federal Republic of Germany applies. If you are a consumer, the mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. Should any provision be invalid, the remainder of these terms shall remain in effect.
